Terms of Service

Welcome to Accountability IRL! These Terms of Service ("Terms") govern your access to and use of the Accountability IRL mobile application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to access or use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old, that you have the legal authority to agree to these Terms, and that all information you provide is truthful, accurate, current, and complete. You are responsible for maintaining the accuracy of your account information.

The Service is a platform that allows users to connect and communicate with one another. We do not conduct background checks, criminal history checks, identity verification, relationship status verification, or any other independent screening of users, and we do not guarantee that any user is who they claim to be or that any user is safe, trustworthy, honest, or suitable for any relationship or interaction. You are solely responsible for evaluating and interacting with other users, and we are not responsible or liable for any user’s acts, omissions, statements, communications, conduct, meetings, relationships, disputes, injuries, losses, or damages, whether occurring through the Service or outside of it.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

If you believe your account has been accessed without your permission, please notify us immediately at admin@accountabilityirl.com.

3. Acceptable Use

You agree that you will not:

• Harass, threaten, intimidate, or abuse other users.
• Post false, misleading, fraudulent, or deceptive information.
• Impersonate another person or organization.
• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Scrape, crawl, copy, or harvest user information or other data from the Service.
• Send spam, unsolicited communications, or commercial advertisements.
• Upload malicious software or otherwise interfere with the operation or security of the Service.

4. User Content

You retain ownership of the content you create, including your profile information, goals, progress updates, messages, and other materials you submit.

By submitting content, you grant Accountability IRL a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and transmit your content solely for the purpose of operating, maintaining, and improving the Service.

You are solely responsible for the content you submit. We do not endorse user-generated content and are not responsible for its accuracy or reliability. We do not verify, review, endorse, or guarantee the accuracy, completeness, or reliability of information shared by users.

5. Premium Subscriptions

Certain features require a paid subscription.

Subscriptions are currently offered as:

• Monthly: $8.99 per month
• Annual: $69.99 per year

Subscription purchases are processed through Apple App Store or Google Play.

Unless canceled at least 24 hours before renewal, subscriptions automatically renew. Purchases made through the Apple App Store or Google Play are subject to the applicable store's billing and refund policies. Refund requests must be submitted directly to the platform through which you purchased your subscription.

Except as required by applicable law or the policies of Apple or Google, Accountability IRL does not provide refunds for partial subscription periods.

6. Content Moderation and Account Termination

We reserve the right to review, remove, restrict, or disable content that violates these Terms or otherwise threatens the safety or integrity of the Service, without notice to the user.

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we reasonably believe may harm other users, Accountability IRL, or the public.

While we may review content for compliance with these Terms, we do not guarantee that all objectionable content will be identified or removed.

7. Sample Content

To demonstrate features of the Service, we may display sample or demonstration profiles, conversations, or other content. When appropriate, this content will be clearly identified as sample content.

8. Medical Disclaimer

Accountability IRL is a peer-to-peer accountability platform. We do not provide medical care, mental health treatment, nutritional counseling, fitness coaching, therapy, or other professional services. We do not verify, review, endorse, or guarantee the accuracy, completeness, or reliability of information shared by users.

Any goals, messages, recommendations, or other information shared through the Service are provided by users and should not be considered medical, psychological, nutritional, legal, or professional advice.

You are responsible for your own health, safety, choices, goals, and decisions. Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, medications, treatment plan, mental health care, or other health-related decisions. Never disregard, avoid, or delay seeking professional advice because of something you read, receive, or discuss through the Service.

If you believe you are experiencing a medical emergency, call 911 or your local emergency services immediately.

9. User Interactions

Accountability IRL is a platform that connects individuals seeking accountability partners. We do not verify the identity, qualifications, background, or conduct of users and do not conduct background checks.

You are solely responsible for deciding whether to communicate with, share personal information with, or meet another user, whether through the Service or outside of it. Any interactions, including phone calls, video calls, messaging through third-party platforms, or in-person meetings, occur entirely at your own risk.

We encourage users to exercise caution when communicating with people they meet through the Service. Never share sensitive personal or financial information, and if you choose to meet another user in person, we recommend meeting in a public place and informing someone you trust.

Accountability IRL is not responsible for the actions, conduct, statements, or omissions of any user, whether those actions occur through the Service or outside of it.

Disputes Between Users. You are solely responsible for your interactions and disputes with other users. Accountability IRL is not a party to, and has no obligation to monitor, mediate, investigate, or resolve, any communication, meeting, relationship, arrangement, or dispute between users. We may take action we believe is appropriate to protect the Service or its users, but we are not required to do so. To the fullest extent allowed by law, you release Accountability IRL from any claims arising out of or related to your interactions or disputes with other users.

10. Intellectual Property

The Accountability IRL name, logo, software, website, mobile application, graphics, designs, text, and other materials provided by us are owned by Accountability IRL, LLC or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, reproduce, reverse engineer, or otherwise use our intellectual property without our prior written permission.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We do not guarantee that the Service will always be secure, uninterrupted, error-free, or available at all times.

12. Assumption of Risk

You understand and agree that using the Service involves certain risks. These risks may include, but are not limited to, relying on information provided by other users, communicating with people you do not know, sharing personal information, setting health, fitness, lifestyle, or accountability goals, and choosing to meet or interact with other users online, in person, or outside the Service.

Accountability IRL does not control, verify, or guarantee the identity, background, statements, advice, conduct, intentions, or suitability of any user. You are solely responsible for your own decisions, communications, interactions, meetings, goals, and personal safety. You agree to use caution, good judgment, and common sense when using the Service and interacting with other users.

To the fullest extent allowed by law, you voluntarily assume all risks arising from or related to your use of the Service, your reliance on any user-provided information, and your interactions with other users, whether those interactions occur on the Service, outside the Service, online, in person, or otherwise.

13. Limitation of Liability

To the fullest extent permitted by law, Accountability IRL, LLC and its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Service.

You understand that Accountability IRL, LLC does not verify the identity, background, relationship status, character, intentions, or suitability of users. We are not responsible for what users say or do, or for any harm, loss, injury, dispute, or damage that may result from your interactions with other users, whether those interactions happen on the Service, outside the Service, online, in person, or otherwise.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid to Accountability IRL during the twelve (12) months immediately preceding the event giving rise to the claim.

14. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles.

15. Changes to These Terms

We may modify these Terms from time to time.

If we make material changes, we will provide notice through the Service, by email, or by another reasonable method.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
